Fair Use Policy
This Fair Use Policy governs the use of services provided by DeluxHost. It applies to all customers using our VPS servers, VDS, dedicated servers and related offerings.

Preamble
This Fair Use Policy (hereinafter also "FUP") governs the use of services provided by DeluxHost (owned by Matteo Martelloni, sole trader, VAT IT17734661006). It applies to all customers using our VPS servers, VDS, dedicated servers and related offerings (hereinafter the "Services"). The FUP is an integral part of the Terms of Service (ToS) accepted by the customer upon activation of the Services and supplements them. In the event of conflict between this FUP and the ToS, the Terms of Service shall prevail. Use of the Services constitutes full acceptance of this policy. Violation of the provisions contained in this document may result in the measures described in Section 6.
1. Purpose and Scope
DeluxHost provides optimized computing and network infrastructure, particularly suited for online gaming and game server hosting, but also usable for other types of workloads in compliance with this FUP. The FUP has a dual objective:
- Ensuring that all customers have stable, high-performance, and reliable access to the shared infrastructure.
- Preventing abuse of network, computing, or storage resources that could harm other customers, the infrastructure, or third parties.
2. Fair Use of Bandwidth
DeluxHost does not apply hard caps on monthly traffic for its Services. We instead monitor average consumption per node in order to identify behavior that deviates significantly from the average and could degrade service quality for other customers sharing the same infrastructure. Customers whose bandwidth consumption is significantly above the average for their node and causes a measurable degradation in performance may be subject to intervention, following the procedure described in Section 6.
2.1 Indicative thresholds by service type
The following thresholds are indicative monthly values, not binding limits. Exceeding these thresholds does not automatically result in any penalty — it becomes relevant only when consumption concretely impacts the performance of the shared infrastructure or the quality of service for other customers.
- VPS / VDS servers: 15 TB – 25 TB per month
- Dedicated servers: 50 TB – 70 TB per month
- Storage servers: 20 TB – 30 TB per month
- Promotional offers: 10 TB – 20 TB per month
3. Permitted Uses
DeluxHost infrastructure may be used for any lawful purpose, including but not limited to:
- Hosting game servers (Minecraft, FiveM, Rust, Counter-Strike, ARK, and others).
- Websites, web applications, APIs, and backends.
- Databases and storage services.
- Personal VPNs and proxies for personal use or a limited number of users, provided that the customer remains fully responsible for the generated traffic (see Section 5).
- Bots for Discord, Telegram, IRC, and similar platforms, provided they are not used for purposes prohibited by Section 4.
- Development environments, testing, build servers, Git repositories.
- Learning, experimentation, and educational infrastructure.
4.1 Illegal content and activities
It is prohibited to use the Services to host, distribute, transmit, or facilitate:
- Content illegal under Italian, European Union, or Netherlands law (location of our datacenters).
- Child sexual abuse material (CSAM) — any report results in immediate suspension and referral to the competent authorities.
- Content that incites violence, terrorism, discrimination, or hatred.
- Copyright-protected material without authorization (warez, pirated software, pirated video/audio, illegal release repositories).
- Phishing, fraud, identity impersonation, sale of stolen credentials.
- Spam and mass sending of unsolicited messages (UCE, UBE), including email campaigns without consent.
- Scams, pyramid schemes, get-rich-quick schemes, investment fraud, fake shops.
- Sale of illegal substances, prescription drugs, weapons, counterfeit products.
- Darknet markets, illegal marketplaces, and related support services.
4.2 Prohibited technical activities
The following activities are prohibited in any form:
- Cyberattacks of any kind: DDoS, DoS, aggressive port scanning, brute force, exploitation of third-party system vulnerabilities.
- Distribution of malware, viruses, ransomware, trojans, worms, exploit kits.
- Stress tests or load tests conducted against third-party systems without written authorization from the owner.
- Management of botnets, command and control (C&C) servers, networks of compromised devices.
- Mass scraping, aggressive crawlers that do not respect robots.txt or that generate abnormal loads on third-party sites.
- Tor exit nodes: running Tor exit nodes is prohibited on the entire infrastructure (non-exit Tor relays and bridges are evaluated on a case-by-case basis — contact support).
- Public speed test servers (e.g., Speedtest.net, publicly exposed iperf): isolated tests for internal use are permitted.
- Rapidleech, debrid, automatic mirrors, mass download systems from third-party services.
- Public video/media streaming services with high continuous traffic (high-bitrate personal streams, IPTV, public broadcasts): consult support beforehand to size the service appropriately.
- Automated bots generating continuous traffic or excessive requests toward third-party services.
- Abusive automation of gaming services (commercial game boosting, bot server farms for games).
4.3 Cryptocurrency Mining
Cryptocurrency mining is prohibited on the entire DeluxHost infrastructure, in all its forms: direct mining (CPU, GPU, ASIC), pool mining, background or opportunistic mining, running blockchain full nodes for the purpose of high-consumption mining/staking, and all scripts or software performing continuous proof-of-work operations. No exceptions are allowed, not even for personal or test use. Running personal wallets, low-consumption full nodes, blockchain exploration, and DeFi applications that do not involve mining is permitted.
5. Customer Responsibility
The customer is fully responsible for everything that occurs through their Services, including the actions of their end users, sub-customers, or guests; traffic generated by their servers; and content published or transmitted through the infrastructure. The customer undertakes to:
- Keep their system updated and secure.
- Use strong credentials and enable two-factor authentication (2FA) on the customer area.
- Act promptly in the event of server compromise or received abuse reports.
- Cooperate with our team in investigations into anomalous activities originating from their Services.
6.1 Standard procedure (minor violations)
For violations of limited severity, DeluxHost adopts a dialogue-based approach:
- 1. Notification to the customer by email with a description of the issue.
- 2. Reasonable timeframe for resolution (generally 24–72 hours depending on criticality).
- 3. In the event of customer inaction: traffic shaping, temporary suspension, or, as a last resort, service termination.
6.2 Immediate suspension or termination (serious abuse)
In the presence of serious violations, DeluxHost reserves the right to immediately suspend or terminate the service without prior notice. The following fall into this category:
- Active outbound DDoS, DoS attacks, or intrusions from our Services.
- Ongoing distribution of malware or ransomware.
- Child sexual abuse material (simultaneous report to the authorities).
- Server compromise used for illegal activities (e.g., active botnet).
- Violation of orders from judicial or public security authorities.
- Activities that jeopardize the integrity or availability of the DeluxHost infrastructure or datacenters.
- Binding requests from our datacenters or connectivity providers.
6.3 Financial consequences
Suspension or termination of service due to violation of this FUP does not entitle the customer to any refund, in whole or in part, of amounts already paid. Any costs incurred by DeluxHost for incident management may be charged to the customer.
7. Data Retention and Deletion
In the event of service suspension or termination, customer data is retained and subsequently deleted according to the timelines indicated in the Privacy Policy:
- Server data: 7 days from the end of service.
- Backups made by the customer through the panel: 14 days total from the end of service.
8. Relations with Datacenters and Network Providers
DeluxHost servers are hosted in third-party datacenters (Qupra DC and Skylink Data Center BV in the Netherlands) and connected through connectivity providers. These parties apply their own Acceptable Use Policies (AUP). In the event of requests or orders from datacenters or network providers, DeluxHost is required to comply promptly. The customer accepts that such requests may result in suspension or intervention on their service with minimal notice.
9. Abuse Reports
Anyone who believes that a service hosted at DeluxHost is committing a violation (spam, phishing, attack, illegal content) can submit a report by writing to abuse@deluxhost.net. Reports are handled promptly. To be processed effectively, they must include: the IP address involved, date and time of the event (with timezone), logs or technical evidence, and a description of the violation.
10. Policy Changes
DeluxHost reserves the right to modify this FUP at any time to adapt to technological, regulatory, or security threat developments. The current version is always published at deluxhost.net with the date of the last update. In the event of material changes, customers will be notified with reasonable advance notice via email to their registered address and/or a notice in the customer area.
